Visa options, requirements, and timelines for Canadian professionals moving to United States.

TN Visa (CUSMA/USMCA)

The fastest work visa for Canadians. Available for 63 professional occupations under CUSMA. Can be obtained at the border with a job offer letter β€” no petition required.

Requirements

  • β€’Canadian citizenship (not just PR)
  • β€’Job offer from a US employer in a qualifying profession
  • β€’Relevant degree or credentials for the profession
  • β€’Can be obtained at a US port of entry or airport
Processing Time:Same day at border, or 2-4 weeks if pre-filing

H-1B Visa

The standard work visa for specialty occupations. Subject to annual lottery cap of 85,000 visas. Three-year validity, extendable to six years.

Requirements

  • β€’Bachelor's degree or equivalent in specialty field
  • β€’Employer sponsorship and petition (Form I-129)
  • β€’Subject to annual cap and lottery (unless cap-exempt)
  • β€’Prevailing wage requirement
Processing Time:Lottery in March, start October. 3-6 months processing.

L-1 Intracompany Transfer

For employees being transferred from a Canadian office to a US office of the same company. No cap, no lottery.

Requirements

  • β€’Employed at Canadian office for at least 1 year in past 3 years
  • β€’Transferring to a parent, subsidiary, or affiliate US office
  • β€’Manager/executive (L-1A) or specialized knowledge (L-1B)
Processing Time:2-4 months, or 15 days with premium processing

O-1 Extraordinary Ability

For individuals with extraordinary ability in sciences, arts, education, business, or athletics. No cap, no lottery.

Requirements

  • β€’Evidence of extraordinary ability (awards, publications, high salary, etc.)
  • β€’At least 3 of 8 criteria must be met
  • β€’US employer or agent sponsorship
Processing Time:2-4 months, or 15 days with premium processing
